APC

Actual Physical Control (APC) is a unique and often misunderstood DUI-related offense under North Dakota law. It means a person is found under the influence of alcohol or drugs while in control of a motor vehicle—even if the car is parked and not running. Simply sitting in the driver’s seat with the keys nearby or in the ignition can be enough to justify an APC charge.

Unlike traditional DUI cases that require evidence of driving, APC laws focus on the potential ability to operate a vehicle while impaired. This charge is frequently brought when police find someone sleeping it off in their car or sitting inside the vehicle after drinking. Even well-intentioned actions—like pulling over to rest—can result in criminal prosecution.

If you're facing an APC charge in Minot, Bismarck, Dickinson, Williston, or elsewhere in North Dakota, it's essential to consult with an experienced criminal defense lawyer. At Heartland Law, we understand how to challenge the state’s definition of “control” and fight for case dismissal, reduction, or a non-criminal resolution.
