Conspiracy

In North Dakota, conspiracy is a criminal offense that involves an agreement between two or more individuals to commit a crime, combined with at least one overt act in furtherance of that agreement. It does not require the actual completion of the intended crime — just the agreement and a step toward its commission.

Under North Dakota Century Code § 12.1-06-04, a person is guilty of conspiracy when, with intent to promote or facilitate the commission of a crime, they agree with one or more persons to engage in conduct that constitutes the offense, and one of them commits an overt act in furtherance of the conspiracy.

Conspiracy charges can accompany virtually any criminal allegation, including drug offenses, theft, assault, fraud, and even homicide. Prosecutors often use conspiracy to implicate individuals who may not have committed the main crime but were allegedly involved in the planning or preparation.

Because conspiracy charges can be vague and heavily reliant on circumstantial evidence, they require a strategic and aggressive defense. At Heartland Law Office, we scrutinize the prosecution’s case, challenge the existence of an agreement, and expose weaknesses in the evidence to protect your rights.
