Disorderly Conduct

Disorderly conduct is a common criminal charge in North Dakota used to address a wide range of disruptive or threatening behaviors. The law is intentionally broad, and individuals can be arrested for actions such as fighting in public, making obscene gestures or threats, disrupting lawful gatherings, or behaving in a way that causes fear, alarm, or annoyance.

Under North Dakota Century Code § 12.1-31-01, disorderly conduct includes any behavior that is likely to provoke a violent reaction or seriously disturb public peace. Charges often arise from disputes in bars, on the street, in schools, or even in homes when law enforcement is called to de-escalate a situation.

Police and prosecutors in Bismarck, Minot, Williston, and Dickinson commonly use this charge when no more serious offense is applicable — making it one of the most frequently filed misdemeanors. However, being charged doesn’t mean you’ll be convicted. Many cases are resolved through diversion, dismissal, or deferred judgments — especially for first-time offenders.

At Heartland Law Office, we know that disorderly conduct charges are often subjective. We investigate every detail to challenge vague allegations, protect your rights, and resolve your case with the least possible impact on your record and future.
